The Wayne Township Planning commission meets the second Tuesday of every month at 7:00 pm. The Planning Commission
reviews all subdivision and land development plans. They then make a recommendation for action to the Board of Supervisors.
The Chair of the Planning Commssion is Miles Houseknecht.

MEETING MINUTES FOR NOVEMBER 8, 2011
The Wayne Township Planning Commission held their regular monthly meeting November 8, 2011 at 7:00 p.m. at the Wayne Township Building. Members Present: Miles Houseknecht, Rodney Shemory, Anthony Fasano, Susan Johnson and Terry Condo. Also present: James B. Maguire, John Noltee, Robert A. Johnson, Russell Johnson, and Zoning Officer Gary Smith
Terry Condo made a motion to approve the October 11, 2011 minutes as presented seconded by Tony Fasano, the minutes were unanimously approved.
Old Business:
Wolfe Subdivision
The Planning Commission reviewed subdivision plans submitted on behalf of Gary Wolfe which create a one acre building lot at 548 Shoemaker Road. The subdivision was previously approved by the Township for the one acre parcel which was conveyed from Rebecca and Harry Rishell to Gary and Janice Wolfe and included a Non-Building Waiver.
The property is now being conveyed to Gary’s granddaughter, Ashley Crawford, who plans to build a home on the property making it necessary for the subdivision to be re-approved as a one acre building lot.
All the required paperwork was submitted with the subdivision with the exception of the driveway permit and an additional four copies of the subdivision plans must be submitted as six copies are required for approval.
Terry Condo made a motion to approve the plans as submitted on the condition that the plans are not signed until the correct number of plans are submitted and a Driveway Occupancy Permit is obtained. The exact location of the driveway is also to be shown on the plans. The motion was seconded by Rodney Shemory and was unanimously approved.
Conditional Use Application of H2O Express, LLC
The Planning Commission again reviewed the Conditional Use Application of H2O Express, LLC for property owned by Russell Johnson located at Johnson Lane and Shoemaker Road. The property consists of approximately three acres, is zoned Light Industrial and the application requests use of the property as rental space for commercial vehicles used for the gas and oil industry in accordance with Township Ordinance No. 7.21.03.1.
Mr. Johnson currently owns eight trucks and the hours the trucks leave the parking site are generally between 5:00 – 8:00 am, returning between 4:00 - 5:00 pm. He also noted that there are days when drivers are “on call” and the normal schedule is not followed.
A discussion was held regarding the plans for the parking area and the amount of impervious coverage permitted in the Light Industrial Zoning District (70%). It was noted during the October Planning Commission meeting by Mr. Johnson that a storm water management plan has been completed for the site. Also, the E&S plan for the site has been approved by the Clinton County Conservation District.
Chairman Houseknecht noted that the plans were revised and now shows the amount of impervious coverage; location of the parking area; the size of the parcel; and the fire hydrant.
Rodney Shemory brought up safety concerns due to the additional truck traffic being created on Shoemaker Road.
Mr. Johnson said it is his company’s policy that drivers travel 25 mph on Shoemaker Road as it is a residential area where he and his family live and wants to keep children and families living and traveling along the road safe. Truck drivers also have been asked to watch out for children and to keep their distance from school buses.
Rodney Shemory asked about requiring Mr. Johnson to bond Shoemaker Road. He also asked how many businesses were located along Johnson Lane.
Jim Maguire stated that studies have been done on Shoemaker Road to make repairs to the road that would include resolving some of the storm water problems and to replace culverts. However, the Township only owns a 33 ft. right of way and more right of way is needed in order to make improvements to the road and since property owners will not work with the Township in order for repairs to be made, the Township would have to proceed through eminent domain.
Jim Maguire stated that there are currently four businesses utilizing Johnson Lane with limited truck traffic.
Terry Condo made a motion to send a letter to the Supervisors recommending approval of the conditional use application and to consider the following when determining conditions on the approval:
(1) Require the current truck parking area on the lower portion of the Johnson property be vacated and that the upper portion of the property be used for parking to avoid contamination of Cobbs Creek.
(2) The safety aspect of vehicles traveling on Shoemaker Road should be considered.
The motion was seconded by Susan Johnson and was unanimously approved.
UCC Opt-In
Jim Maguire said the Township Supervisors are in the process of opting in under the Uniform Construction Code and explained the Township must hire or contract with a building code officer who is certified under the UCC, simultaneous to the enactment of an ordinance; and second, an Appeals Board must be established to hear appeals from any decision made under the UCC denying a request. The Board of Appeals must consist of a minimum of three individuals in the construction business. The Supervisors can go outside of the Township if they cannot find residents within the Township that are qualified to serve on the Board of Appeals.
Villello Building Inspections has agreed to act as the UCC Officer and the Township has an alternate to serve on the Board of Appeals. Mr. Maguire asked Planning Commission Member Terry Condo if he would serve on the Board of Appeals, and if so, he asked Terry to submit a letter to the Supervisors accepting the position.
Terry Condo agreed to serve on the Board of Appeals and will be providing a letter to the Board accepting the position.
Zoning Officer Smith said he is currently working on updating the Supplement to the Township Zoning Ordinance and eventually he would like to combine the Zoning Ordinance and Supplement into one book. Mr. Smith said he also plans to begin working with Planning Commission Member Rod Shemory on updating and correcting the Township’s Zoning Map in the near future.
There being no additional business, Terry Condo made a motion to adjourn the meeting, seconded by Rodney Shemory, the motion passed unanimously and the meeting was adjourned at 8:30 p.m.
